These Terms of Use ("Terms") govern your access to and use of the website at muskegonsurfcam.com and its related services, including the live webcam, weather and marine information, and sustaining‑member features (collectively, the "Service"). The Service is operated by Michigan Dawn Patrol LLC, a Michigan limited liability company ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Informational service only
The Service provides a live camera view and weather, wind, wave, and forecast information for general informational and entertainment purposes only. It is not a professional, official, or safety‑critical information source.
2. No reliance; assumption of risk
You must not rely on the Service for navigation or for any decision affecting health, safety, or property. Water activities such as surfing, kiteboarding, boating, paddling, and swimming are inherently dangerous. Conditions can change rapidly and may differ from what the Service shows.
Before entering the water or making any decision, consult official sources such as the U.S. National Weather Service and the U.S. Coast Guard, and use your own independent judgment. You assume all risk arising from your use of, or reliance on, the Service and any information it provides.
3. Memberships, billing, and cancellation
- Subscription. Sustaining membership is an auto‑renewing subscription billed at $5.00 per month until cancelled.
- Auto‑renewal. By subscribing, you authorize us and our payment processor to charge your payment method $5.00 each month automatically until you cancel.
- Cancel anytime. You may cancel at any time through the "Manage subscription" link in the members area. Cancellation stops future charges and your membership remains active through the end of the current billing period.
- No refunds. Except where required by law, payments are non‑refundable and we do not provide refunds or credits for partial billing periods.
- Payments. Payments are processed by Stripe. We do not store full payment card details. You must be at least 18 years old to purchase a membership.
- Price changes. We may change membership pricing on a going‑forward basis with reasonable notice.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful, harassing, or harmful purpose;
- Use the member camera‑control features to track, target, harass, or invade the privacy of any individual, or to attempt to identify or zoom in on specific people;
- Copy, scrape, redistribute, resell, or create derivative works from the live feed, data, or other content without our written permission;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
The camera streams a view of a public beach and surrounding area. By using the Service you acknowledge that the camera operates in and records a public space.
6. Intellectual property
The Service, including its design, logos, video stream, and original content, is owned by Michigan Dawn Patrol LLC or its licensors and is protected by applicable laws. We grant you a limited, revocable, non‑exclusive, non‑transferable license to access the Service for personal, non‑commercial use, subject to these Terms.
7. Third‑party services and links
The Service incorporates or links to third‑party content and services, including NOAA data, forecast widgets, payment processing (Stripe), and advertising (Google). We are not responsible for third‑party content, services, or practices, which are governed by their own terms and policies.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non‑infringement. We do not warrant that the Service will be uninterrupted, secure, error‑free, or that information will be accurate or timely. See our Disclaimer for more.
9. Limitation of liability
To the maximum extent permitted by law, Michigan Dawn Patrol LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, personal injury, or property damage, arising out of or relating to your use of (or inability to use, or reliance on) the Service, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US $50.00.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Michigan Dawn Patrol LLC and its members, managers, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains what information we collect and how we use it.
12. Changes to the Service or these Terms
We may modify or discontinue the Service at any time. We may update these Terms from time to time; the "Last updated" date reflects the latest version. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and indemnification) will survive.
14. Governing law and venue
These Terms are governed by the laws of the State of Michigan, without regard to its conflict‑of‑laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Muskegon County, Michigan, and you consent to the personal jurisdiction of those courts.
